SC stays airing of KARISHMA on Sahara TV


Karisma KapoorThe Supreme Court stayed a Calcutta High Court order giving the go ahead for telecast of the mega serial KARISHMA- A Miracle of Destiny on Sahara TV. May 12 was the day of activity for both sides - the Sahara TV and the New York-based novelist Barbara Taylor Bradford, who had sought stay of the airing of the serial alleging that the serial was based on her novel A WOMAN OF SUBSTANCE.

The Sahara TV moved the single Judge Bench of the High Court seeking vacation of an injunction order of May seven restraining the TV channel from airing the serial. Unsuccessful in their attempt, the TV channel moved the division Bench of the High Court in the afternoon and got stay of the injunction order.

Not giving up, Barbara, through her solicitor Fox Mondal, filed an appeal before the vacation Bench in the evening and the Bench of Justice N Santosh Hegde and Justice Shivaraj V Patil heard the Special Leave Petition at home late in the evening and in an ex-parte order stayed the airing of the serial. The Bench, while issuing notice to Sahara TV, stayed the order of the division Bench of the High Court and posted the matter for detailed hearing after hearing counsel A K Ganguly and Parag Tripathy for the novelist.

Asked whether Barbara would move the Court with a contempt petition as the TV channel had telecast the serial last night despite the Supreme Court order, the solicitors said their client was contemplating on this issue.
